Alberta redefines a "mentally incompetent person" in the "Mental Health Act"

Alberta redefines a "mentally incompetent person" in the "Mental Health Act"

1972. The "Mental Health Act" redefines a "mentally incompetent person," in Section 66(a)(iv)(e) in Alberta, Canada. The redefinition is as follows:

A “"mentally incompetent person” means a person in respect of whom a certificate of incapacity has been issued or is deemed to have been issued pursuant to The Mental Health Act, 1972." A certificate of incapacity is issued when it is determined that “a formal patient is incapable of managing his affairs.”

This represents a new definition from the "Lunatics' Estates Amendment Act," of 1925, and the "Estates of the Mentally Incompetent Act" of 1937/1945.
